The season of LOVE is upon us.

Has LOVE been good to you? Have you been smitten by its beauty and captivated by its passion? Does the mention of your loved one fill you with joy?

Or is it a season which weighs upon you. Its trials and tribulations, the heartbreaks, quarrels, cheating, possessiveness, you know what we mean, right?

IS LOVE - The most amazing feeling in the world or just another four letter word?

Whether you're a full-time Aashiq or frustrated Romeo, pick up that camera and show us what love means to you -good or bad, funny or sad, beautiful or ugly, all aspects of it!

This contest is your chance to submit a short film less than 20 minutes on either LOVE or its SIDE EFFECTS, as you perceive them. In this season of love express your feelings through a film and win some amazing prizes.


1 What are we looking for?
Short Films on the theme of
a. Love, romance, affection, etc.
b. The side effects of love including breakups, commitment phobia, possessiveness, manipulation, emotional blackmail and so on. This is the season of love and some light-hearted fun is welcome.
2 Duration Maximum – 20 minutes (excluding credits)
3 Deadlines Last Date of Submissions – 14th February 2017

Terms:
1. The equipment offer is from Accord Equips' offices in either Mumbai or Pune.
2. Conveyance, Travel, Attendant, etc. charges will be extra as applicable
3. Additional equipment required, if any, will be charged extra and payable by the Participant directly to Accord Equips.

The Equipment Package offered by our Accord Equips. The eligible winners are required to deal directly with Accord Equips to claim the offer and Pocket Films is not responsible or liable for the same.

TERMS RELATING TO THE CONTENT:

1. The film (the term ‘film’ also includes the supporting details and metadata, wherever applicable) shall not be more than 20 minutes in duration, excluding credits. Films exceeding this time limit may be rejected. We recommend keeping the credits at the end of the film and under 30 seconds.

2. The films may be in their original language but MUST be subtitled in ENGLISH. Films in English language too should have subtitles in English. We recommend subtitles be submitted in .srt format as far as possible and submit to us along with your film. 3. The films may be shot in any format. However, the recommended ratios are: 16:9 / 16:9 Full Height Anamorphic – in DV / HDV. The recommended video files formats are VOB, MPG, MPEG4 or AVI.

4. In making your Film, you must have (1) obtained appropriate releases for every person who appears recognizably in your Film; (2) obtain appropriate releases for those locations that appear recognizably in your film and require releases; (3) obtained appropriate releases from producers, right-holders and/or co-producers You will retain any such releases and provide them to the Pocket Films upon request.

5. The Film must not contain any copyrighted work(s) belonging to third parties unless (1) you have a license to use such works in the Film; or (2) the use your Film makes of such works is a fair one under the copyright laws. You will retain any licenses and provide them to Pocket Films upon request.

6. The participant opting for Regular Submission grant Pocket Films, the limited non-exclusive rights to screen (non – commercial) their film on it’s website, at any event related to the contest and other associated screenings for the period of one year from the last date of submission, for which they are not entitled to any fee or consideration of any kind whatsoever.

7. The Participant also grants Pocket Films the right to use their name, image, voice, likeness, statements, background and biographical material in connection with the contest.

THE GENERAL TERMS OF PARTICIPATION:

1. The Participant hereby confirms that he/she/it is the owner / rights holder and/or their authorised representative and has the necessary rights and authority to submit the entry/film by accepting the terms and is solely responsible for the same. The Participant indemnifies the Pocket Films against any claims regarding the said film submitted herein.

2. The Participant confirms that he/she is 18 years of age as on 1st January 2017.

3. To the extent permitted by law, each participant waives and releases Pocket Films from any and all claims that participant may now or hereafter have in relation to moral rights or unfair competition with respect to Pocket Films management of the contest and resultant exploitation of the film(s) as applicable without further notification to Participants of any kind. In the event that the waiver of moral rights as stipulated above is unenforceable or invalid, Participants hereby acknowledge and agree that Pocket Films are authorized to exercise all moral rights to the film, including but not limited to a right to publish, alter and adapt such film, and, where applicable, also to join such film(s) with other works and include such films into a collective work or database.

4. All communications from our end as well as the benefits, if any, will be only with/to the Participant.

5. Transfer, assignment or substitution of the prizes / benefits to a person other than the participant, will not be permitted. However, in exceptional cases the Pocket Films reserves the right to entertain such request at their discretion.

6. The decision of the jury shall be final, unquestionable and binding on all participants.

7. Once submitted the entries cannot be withdrawn for any reason whatsoever.

8. The Pocket Films may reject any film without assigning any reason whatsoever and the same cannot be challenged.

9. All materials, documents, etc. submitted for participation shall not be returned under any circumstances and shall become the property of Pocket Films.

10. To the fullest extent permissible by applicable law, the Pocket Films shall not be liable for any economic losses, loss of goodwill or reputation or special, indirect or consequential losses (whether or not such losses were within the contemplation of the Participant and us at the date of the upload/submission of the Entry for the contest) suffered or incurred by the Participant arising out of or in connection with these Official Rules and Terms. Pocket Films’ aggregate collective liability arising from or relating to the contest and/or these Official Rules and Terms (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to INR 2000/-.

11. The participant agrees and accepts that the Pocket Films shall not be held responsible for any unauthorised use of the film or related metadata by any third party.

12. Some of the terms are used interchangeably in the agreement but have the same meaning eg. “The Participant” is the same as “You”, “all” means “any” and vice versa, “Pocket Films” mean Pocket Films and / or Onetakemedia.com Private Limited, as applicable.

13. The Pocket Films reserve the right to modify the terms and conditions of the contest without any intimation to the participants at any time after the launch of the contest. Such changes will be applicable to all participants.

14. The headings to each section are for reference and easier reading and shall not affect the meaning of the terms as mentioned herein

15. Entry and participation of films implies unconditional acceptance of these terms and regulations.

16. Pocket Films’ decision in all matters pertaining to this contest and distribution terms herein shall be final and binding in all respects.

THE RIGHTS RELATING TO THE PARTICIPATING ENTRY UNDER SPECIAL FEES (FREE) AND OFFERING THEIR FILM FOR DISTRIBUTION

1. The IPR of the film belongs to and will continue to rest with the participant / film
maker.

2. Any person(s) who are under any contractual or other obligation that would prohibit them from allowing Pocket Films to license the entry on an exclusive, worldwide, residual-free and royalty-free basis, in all media formats and uses, in accordance with the terms below, are also ineligible to enter this contest

3. The Participant has the right to participate with the film in any other film festival provided they do not part with the rights granted herein. Prizes, awards, etc. from such participation, if any, may be retained entirely by the Participant.

4. The Participant, hereby represents and warrants as under:
a. The Participant is the rightful owner(s) of the film and/or have the absolute right and authority from the producers/right holders, to deal with the same, including participation in this contest by accepting the terms and conditions, in particular the rights granted to Pocket Films for distribution of the film as detailed hereinafter.
b. The Participant confirms that the content, in full or part, does not violate the copyright of any third party.
c. The Participant hereby confirms that they have not granted any rights nor will they grant any rights in the future relating to the participating film/entry/content which could adversely affect the rights granted to Pocket Films for distribution of the said content
d. The Participant further indemnifies the organisers Onetakemedia.com Private Limited / Pocket Films (www.pocketfilms.in) and holds it harmless if it incurs any loss, cost, or expense (including attorneys’ fees), due to any claim by self or any other parties relating to the content and / or their exploitation of the same.

5. The Participant also indemnifies Pocket Films from any claims that may arise as a result of the breach of the terms and conditions of this contest by the Participant.

6. The Participants further confirm and agree to edit / modify the submitted film to the extent required by Pocket Films in the event Pocket Films informs them of a potential copyright infringement / violation. The participant further agrees to provide all documentary proof and evidence with regards to the rightful ownership of the content as may be required by Pocket Films at any point in time. The Participant further agrees and confirms resolve the copyright / content / ownership related issues with 15 days of the same being raised by Pocket Films. In the event, the issues remain unresolved with the stipulated period, Pocket Films reserves the right to distribute the film either by editing / modifying the same as it deems fit and/or in its original form at the risk and liability of the Participant.

7. By entering to this contest, the Participant hereby grants Pocket Films an irrevocable and royalty free license to use and monetise the film, as well as his/her/its name, image, voice, likeness, statements, background and biographical material. These rights are granted exclusively to Pocket Films for distribution, exploitation and monetisation on internet and mobile platforms, known today or may be introduced in the future, including but not limited to Pocket Films’ own mobile application and internet website / portal. The participant further grants Pocket Films non-exclusive rights to exploit and distribute the film on platforms other than internet and mobile. All rights are granted for worldwide territory.

8. The rights granted herein to Pocket Films by the Participant are for a lock-in period of 5 years from the date of this agreement and/or the submission of this film whichever is later. The agreement shall automatically be renewed for subsequent periods of 5 years unless either party expresses to the other its intent to terminate the agreement in writing, 30 days prior to the date of such renewals.

9. In the event the Participant wants to terminate the agreement in the lock-in period or such extended period, the request may be considered by Pocket Films at its discretion and on payment of a penalty equivalent to Rs. 25,000 or the revenue share generated by the film in the previous six months whichever is higher. Pocket Films may also call upon the Participant to make payment of such penalty if the Participant does not comply with the requirements as stated in clause 6 hereinabove,

10. To the extent permitted by law, each participant waives and releases Pocket Films from any and all claims that participant may now or hereafter have in relation to moral rights or unfair competition with respect to Organizers exploitation of films without further notification to Participants of any kind. In the event that the waiver of moral rights as stipulated above is unenforceable or invalid, Participants hereby acknowledge and agree that Organizers are authorized to exercise all moral rights to the film, including but not limited to a right to publish, alter and adapt such film, and, where applicable, also to join such film(s) with other works and include such films into a collective work or database.

11. The term ‘Distribute’ and/or distribution shall apply to the film and or content and mean and include distributing, exploiting, sub-licensing, exhibition, screening, broadcasting, simulcasting and any and all means of enabling the content to be consumed across mediums or platforms.

12. By participating with your film to the
contest, you irrevocably allow organizers and
grant Pocket Films a worldwide, royalty free licence (where relevant, by way of present licence of present and future copyright) to:
a. Copy, reproduce, adapt, translate, alter, rearrange, edit, cut, dub or subtitle in any language, and add to or delete from your film (including without limitation the right to extract audio only or picture only content from the film), in any way whatsoever, for the purpose of making and producing, advertising, promoting, publicising, broadcasting, exhibiting, distributing, exploiting and communicating to the public and to include the film (or any such altered or edited version of the film) whether as a single sequence or a series of sequences and preceded or followed by and interlaced with such other content (including without limitation any commercial breaks) as Pocket Films determines in its sole discretion;
b. Advertise, promote, publicise, broadcast, exhibit, distribute, monetise and exploit the film (and any clips from the film) or any such altered or edited version of the film, throughout the world in in all media and platforms and by any and all means now known or devised in future; and
c. Publish your film, or any part thereof, to the public via the Pocket Films’ Channel, including without limitation for promoting and redistributing part or all of the Pocket Films Channel in any media formats and through any media channels
d. The right to enter into agreements with any third party with regard to the exploitation, distribution and/or monetisation of the said rights of the film
e. The Participant shall not claim any rights or compensation for the film except those mentioned in the “revenue share” section here-under.

THE REVENUE SHARE FOR PARTICIPATING ENTRIES UNDER SPECIAL FEES (FREE) AND OFFERING THEIR FILM FOR DISTRIBUTION


1. The participant shall be entitled to a 37.50% share of the Gross Revenues earned and received by Pocket Films through distribution of the participant’s film.

2. Gross revenues shall mean the actual amounts received by Pocket Films only for the respective content and after deduction of all applicable taxes, cesses, levies, payment collections costs including credit card related qcollection costs from the said content.

3. In the event the film is licensed as a part of a package then “Gross revenues” shall mean the amount received by Pocket Films for the content (films) only and after deducting the expenses as mentioned hereinabove from the total receipt and the share proportionate to the weight-age the particular content in the package. The weight-age of the content in the package lot shall be decided by Pocket Films at its discretion.

4. Pocket Films shall draw up the accounts for every calendar quarter, based on the statements provided by the distribution partners, agencies, operators, third parties, etc. hereinafter referred to as “The Said External Parties”. The payment shall be issued within 60 to 75 days after the end of such accounting period and subject receipt of the monies from the said external parties and the share the Participant’s is over Rs. 1,000. If the total revenue due to the Participant is less than Rs. 1,000, the due amount shall be carried forward to the next accounting period. The Participant shall raise an invoice for the amount of revenue share receivable by it from Pocket Films on the basis of the reports provided by Pocket Films. All payments shall be subject to withholding and other taxes as applicable. Payments shall be calculated in Indian Rupees and currency conversion charges and other charges, if any, pertaining to the issuance of the payment outside India shall be borne by the Participant.

5. The Participant accepts that at times Pocket Films may distribute the film on platforms free or on a complimentary basis thereby not generating any revenue from the distribution. In such cases, the Participant shall not be entitled to any payment / revenue share for such distribution.

6. All rights are granted for worldwide territory.

7. Pocket Films reserves the right to terminate the agreement at any time by giving an email notice to the Participant without providing any reason whatsoever.
