OFFICAL RULES AND AGREEMENT FOR ENTRY
What the Dickens Orlando Creative Flash Mob Video Contest
What the Dickens Orlando is offering a cash prize of $5,000 to the best flash mob video that is built around a song from a musical inspired by the works of Charles Dickens. Examples include “Who Will Buy” or “Food, Glorious Food” from Oliver! and “Thank you Very Much” from Scrooge. To be eligible, a video cannot be longer than 7 minutes, and must be posted on YouTube by 5 pm Eastern Standard Time (GMT -5) on Friday, December 5, 2014. A panel of judges will select the winning video based upon overall performance quality, audience reaction, visual impact and use of the physical space by the mob.
What the Dickens Orlando is a celebration of the 202nd anniversary of the birth of Charles Dickens–his life, work, times and issues by three dozen arts and cultural organizations in Orlando, Florida who are presenting more than 202 event-days of related performances, exhibitions and activities throughout Orlando in 2014.

Judges: The winning video will be selected by the end of December, 2014 by a panel of judges representing the Orlando Philharmonic Orchestra, the Orlando Ballet, the Mad Cow Theatre and the Orlando Shakespeare Theater. The Judges will review all entries. At the judges’ discretion, some or all of the entries will be presented at a public screening to celebrate the contest.
Award for winning entry: The prize money of $5,000 will be sent to the one (1) winner by January 10, 2015 upon receipt of required financial forms.
Agreement for entry: By submitting an entry into the What the Dickens Orlando Creative Flash Mob Video Contest (the “Contest”) you are automatically agreeing to be bound by all the terms and conditions of this Agreement for Entry and the Entry Form. DO NOT SUBMIT AN ENTRY IF YOU DO NOT AGREE.
Contest Outline
Eligibility: Any performance organization, individual, or group of individuals anywhere in the world may create and submit a video in any language. (Non-English-language performance must submit an English translation or provide English sub-titles.)
Performance must be of a song from a musical inspired by one of the works of Charles Dickens. If you have questions about the eligibility of a song, send an inquiry to Terry@WhatTheDickensOrlando.com.
Music: It is preferable to have a live performance of the score, or of the singing, or both. The instrumentation or the singing may be recorded separately from the video, but we prefer a video where at least one is performed live while filming the flash mob’s staging/choreography.
Video: The video must include candid shots of surprised people encountering the flash mob as well as shots of the performers. Video and audio quality is important. The video must be posted by you on YouTube, so it must meet all of the YouTube technical and legal standards.
Credit: You should include in the “credits” section of your video, all of the persons or organizations who deserve credit or mention. In addition, you must include the phrase “For www.WhatTheDickensOrlando.com” in English in two places: (1) in the credits, and (2) clearly/legibly displayed in your video in some way (for example, on signs, on dozens of T-shirts, etc.) for at least 4 consecutive seconds.
How to Enter:
1. Read the Official Rules and Agreement for Entry (above) and the Terms and Conditions of Contest (below).
2. Post your Video on YouTube. In order to enter the contest and be eligible for the prize, you must send a link to your YouTube video within the entry form by December 5, 2014, in order for your entry to be eligible.

TERMS AND CONDITIONS OF CONTEST
By submitting an entry into the What the Dickens Orlando Creative Flash Mob Video Contest (the “Contest”) you are automatically agreeing to be bound by all the terms and conditions of this Agreement for Entry and the Entry Form. DO NOT SUBMIT AN ENTRY IF YOU DO NOT AGREE.
Your Rights: You will continue to own your own rights to your video. However, you are agreeing to allow What the Dickens Orlando to show the video at one or more public performances, and to make copies for use by the judges and for limited publicity purposes, in accordance with the Limited Release set out below.
Other Peoples’ Rights: You are responsible for securing the rights to perform the music, record it and distribute it in a video, including one posted on YouTube, and all other rights and permissions that may be needed to produce and film your video.
Your entry constitutes your promise and warranty to What the Dickens Orlando that you have all legal rights to use the images, sounds, and music in your video, together with all permissions that may be needed in your jurisdiction for the rights to show the faces and names of people and organizations that appear in the video.
You must read the YouTube Terms of Service carefully and comply with all of its requirements. See the Terms of Service at https://www.youtube.com/t/terms. Any video that is rejected by YouTube or which is found not to meet its standards is ineligible for the cash prize.
Limited Release: By submitting my entry to the Contest, you, on behalf of yourself and all the persons involved in producing the video you are submitting, hereby authorize What the Dickens Orlando, including its judges and staff, to do the following without compensation to you or your organization or group:
1. To record the video on videotape, audiotape, digital images, film or any other media, for the limited purposes of conducting the judging of the contest, of showing the video, I whole or in part, at one or more public displays associated with the Contest, including on local access cable TV in the Orlando, Florida area.
2. To display your image, likeness, voice, appearance, photograph, name, biography, and any statements, interviews, and / or performances conducted by you, or those of your organization or group, that are associated with or part of the video that you submit.
You understand that What the Dickens Orlando is under no obligation to use the video that you submit in any manner. You agree that What the Dickens Orlando and its staff and judges have no legal obligation to either accept your video for judging, or to declare it to be the winning entry. ALL DECISIONS CONCERNING THE ELEGIBILITY OF THE VIDEO FOR ENTRY, AND THE SELECTION OF THE CONTEST WINNER ARE VESTED IN THE SOLE, COMPLETE AND UNFETTERED DISCRETION OF WHAT THE DICKENS ORANDO, ITS STAFF AND THE JUDGES.
You hereby declare this Limited Release to be irrevocable and you expressly release What the Dickens Orlando and its staff and judges from any and all claims, known or unknown, arising out of or in any way connected with the uses described in this Agreement.
You proclaim and promise that you have the right to enter into this Agreement and to give this Limited Release and that your promises and the rights you have granted hereunder will not conflict with or violate any commitment or understanding you, your organization or group have to or with any other person or entity.
Indemnification: In consideration of the opportunity to submit your Video and to compete for the Contest prize, you, your organization or group, agree to defend, indemnify and hold harmless What the Dickens Orlando and its staff and judges from any and all claims, liabilities, damages, losses, costs and expenses, including, but not limited to, reasonable attorneys’ fees,
arising from your production of and submission of your video to the Contest, any breach by you of these Official Rules, or any claim that the video submitted by you caused damage to a third party. What the Dickens Orlando and its staff and judges reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and all negotiation for its settlement or compromise and you agree to fully cooperate upon request. This obligation to indemnify shall survive the completion of the Contest.
Limitation of Liability: YOU UNDERSTAND AND AGREE THAT, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WHAT THE DICKENS ORANDO, ITS STAFF AND THE JUDGES, SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, OF ANY KIND, DIRECT OR INDIRECT, IN CONNECTION WITH OR ARISING FROM YOUR PRODUCTION OR SUBMISSION OF YOUR VIDEO, INCLUDING, BUT NOT LIMITED TO, COMPENSATORY, CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES.
Jurisdiction, Venue, Choice of Law. These Official Rules, Agreement for Entry, and the Contest itself shall be governed by the laws of the State of Florida, USA. For any legal actions or proceedings between you, your organization or group, and What the Dickens Orlando or its staff or judges, arising from these Official Rules, Agreement for Entry, and the Contest itself, you, your organization and group agree to the exclusive jurisdiction and venue of the courts of Orange County, Florida. The successful party in any such action or proceeding shall be entitled to recovery of their attorney’s fees and costs. YOU, YOUR ORGANIZATION OR GROUP EXPRESSLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY SUCH ACTION OR PROCEEEDING.
