The “Kursaal Film Festival San Sebastián” (KFFSS) is a streaming Video On Demand (VOD) festival of short films promoted by the Kursaal Kino Cultural Association (A2K).
By enrolling in the KFFSS, the participating filmmaker agrees to be bound by the following
PARTICIPATION BASES

Registration is free.

1/.- REGISTRATION REQUIREMENTS:
• Duration between 3 and 15 minutes.
• Genre of short films is free, within the framework established by these bases.
• Each participant can submit up to 2 short films.
• The short film must not have been presented in previous editions.
• Date carried out after January 1, 2017.
• Accessible by Youtube (in hidden mode) or Vimeo (with access code).
• Languages: The short film in any language, but with the obligatory subtitles in Spanish or Basque. Subtitles in other languages such as English are welcome.
• As an international festival, works from any country are accepted.
• The registration must be made by the director, the producer or by the legal representatives of the distribution of the short film (hereinafter the filmmaker), who must have the rights to the contents of the work and the rest of the materials that they contribute.
• They must be original artistic works, excluding mere reproductions of events of any kind and those of an advertising nature.

2 /.- FORMATS:
a) .- Format 16:9
b) .- MP4, MOV, AVI are supported.
c) .- Subtitles in SRT format selectable, preferably not inserted in the video.

3 /.- PROGRAM:
1.- Registration from April 1 to June 30, 2022.
2.- Festival in VOD from September 15 to 30, 2022.
3.- Awards ceremony and streaming of winners September 30, 2022.

4 /.- AWARDS:
“FILMMAKER’S DRAGONHEART” Award:
- Best FICTION short film
- Best ANIMATION short film
- Best DOCUMENTARY short film

DIPLOMA Award:
- PRODUCED IN BASQUE
- THE VALUE OF EQUALITY
- A WORLD WITH DIVERSE PEOPLE
- WOMEN FILMMAKERS
- YOUNG FILMMAKERS (up to 35 years old)

The DIPLOMA awards will be selected from among the finalist nominees for the Fiction, Animation and Documentary awards.

5 /.- REGISTRATION PROCESS
Registration and pre-selection will be made through the Festhome platform.

Once the short film has been preselected, the filmmaker will be notified to register online on the VOD platform of the KFFSS festival as a requirement to enter the competition phase as “Officially Selected”, and the short film cannot be withdrawn or changed on YouTube or Vimeo from that moment. The filmmaker agrees to keep his selected short film accessible to the KFFSS, on YouTube (in hidden mode) or Vimeo (with access code), for the duration of the festival.

A Jury chosen by KFFSS will determine the short films nominated finalists and the winners of the different awards. The jury's decisions will be secret and unappealable.

7 /.- GUARANTEES AND RESPONSIBILITIES OF THE PARTICIPANTS.
In order to respect the rights of third parties and to avoid anomalous situations in the development of the KFFSS, it is communicated that:
7.a) .- PROTECTION OF MINORS. KFFSS is a festival aimed at an adult audience (of legal age or 18 years), so KFFSS and A2K cannot control the access of minors. For this reason, KFFSS and A2K cannot accept any responsibility in this regard, warning that parents and guardians will be the only ones responsible for controlling and assisting minors in browsing the KFFSS pages and the festival website, and they will also responsible for enabling any other necessary mechanisms that, where appropriate, prevent access by minors, KFFSS and A2K not admitting any responsibility or claim in this regard.
7.b) .- CONTENT OF THE SHORT FILMS. The participating filmmaker who registers a short film in the KFFSS must have all the intellectual property rights (music, script, etc.), image rights and public distribution by any means necessary for this, will be legally responsible for its content, They will be responsible for its content and for how many declarations, obligations and responsibilities are assumed by the fact of participation in accordance with the bases contained in this document. Short films may not contain any type of illegal or pornographic material, or that violates any third party rights. The participating filmmaker will be solely and exclusively responsible for the claims received by KFFSS, A2K or the jury for this reason, exempting them from any liability arising from its use and assuming the economic or other responsibilities that may arise.
7.c) .- RIGHTS OF SHORT FILMS. Participation in the KFFSS implies the free transfer by the participating filmmakers, without any territorial limitation and for the duration of the festival, of all the rights of reproduction, public communication, making available and distribution of the short films presented to the festival (including fragments or trailers of the same and any type of graphic material of the short films, if required): (i) for their inclusion and dissemination on the festival website, in any of its editions, and in any other section from the festival website; (ii) in other public or private media of KFFSS and A2K, as well as on the web pages of public and / or private entities that participate collaborating with the festival; (iii), for cultural and non-profit purposes. Participants assume that KFFSS may communicate the names of the winners by any means of communication.

8 /.- VARIOUS.
In the event that: (i) there were no participants; (ii) the follow-up was lower than expected, or (iii) the quality of the short films was not the minimum required by KFFSS and / or the Jury, the awards may be declared void or this edition of the festival may be canceled. It may also be modified or canceled, in whole or in part, and the festival postponed, even once it has started, due to force majeure circumstances under consideration by KFFSS.

KFFSS may withdraw from the festival any short film that does not meet the participation requirements required in these RULES or does not comply with them.
In the event of translation of these Terms and Conditions into any other language, the Spanish version will always prevail.
The person in charge of the personal data that is provided as a result of participation in the KFFSS is A2K, who will treat them in accordance with the applicable regulations in Spain and according to the KFFSS privacy policy, which you can also find both in the registration forms at the KFFSS as a permanent link at the bottom of our website.
For any litigious issue that may arise from this festival, both KFFSS and the winners and other participants in it expressly waive any jurisdiction that may correspond to them, and expressly submit to the Courts and Tribunals of the city of San Sebastián (Spain ).

THE ACT OF PARTICIPATING OR ATTEMPTING TO PARTICIPATE IN THIS EDITION OF THE FESTIVAL ASSUMES THE TOTAL ACCEPTANCE OF THESE RULES. IN CASE OF UNEXPECTED SITUATIONS, KFFSS WILL DECIDE AT ALL TIMES.
